How do I find complaints about a certain mortgage company? I typed in the name of the company and I got consumer complaints but nothing is listed, why would they put the name of the company on line but now show the list of complaints?

Mortgage Company Complaints? Where is a high traffic location to voice my complaints about my mortgage company? My home partially burned 2 months ago and I am having a HUGE problem getting the Mortgage company to disburse the Insurance funds back to me so I can rebuild my home. Unfortunately, the mortgage companies have all of the tables turned to help them and the consumer has no recourse but to complain to THEIR customer service departments which gets you nowhere. I would like to try to warn others of what to expect from this company if they are ever faced with a tragedy and need to rebuild their home and need someone to help them, with this company nothing but excuses will be had! My insurance is State Farm and I know exactly how much the check is/was because I had to sign it before I spent $34 sending it overnight to them. State Farm was wonderful, they did everything they were suppose to do and if they weren't required by the mortgage company to include TB & W on the check my home would be getting repaired right now. But instead I am sitting in a mobile home (State Farm provided BTW) with 3 children watching my home sit idle.

Complaint against a Mortgage Broker. How do I file? I feel my Mortgage Broker did me wrong. First, he refused to send me a copy of the Appraisal. Then, he promised me 4 5/8% loan, but it ended up at 5.635%. This is just a few of the complaints, which I won't go into further. How do I go about filing a complaint of this Broker? Anyone have any complaints agains Option Mortgage Lending? If so, I want to talk to you. I was contacted by Kevin at Option Mortgage Lending. He said he could get me a lower interest rate, and I was wanting a 30 year fixed. He said he could set me up with a 30 year at 5%. Sounded great, so I said lets do it. He had a notary come to our house with the papers and we got ready to sign when we noticed the loan was stated 10% for 40 years. I currently had a 6% mortgage. So I immediately called and asked for Kevin, he wasn't reachable - but David was. David said because I had been late with a previous payment, he needed a payment history. So the loan would be 10% for 4 months, then revert to 5% if we made the payments on time. I said I needed this in writing, and he said he was going to fedex me a package, with papers that needed signatures. That the loan couldn't progress until these fedex'ed papers were signed. So I don't know how he made this sound ok, but he did and we signed. I waited for a fedex package that never came. It was now too late to get out of my loan. I called and can not get a hold of David, I was transfered to a man named Edward who told me that there was no fedex package, that yes indeed the loan would revert back to 5% at the end of the 4 months, but that he couldn't give it to me in writing. So I asked to speak with his manager Nathaniel. He is never available. I have tried to call him every day for two weeks, and finally got ahold of him. He told me he would review my case and get back to me. 2 weeks later, he hasn't called me back and won't take my calls. His secretary won't give me his email address or his voicemail. I was lied to, taken advantage of and I am sick over it. I am now trying to get out of this mortgage and into something more suitable for my family. My mortgage payment went from 1309.00 a month to 2548.00 a month.
If i want to file a complaint against my mortgage company who do I complain to in England? My mortgage is fixed now. The Bank of England has slashed interest rate to a record low. I want to know whether the current provider's lending rate is in line with the Bank of England base rate. If this is the case, is there a way I could come out of the fixed mortgage and switch to standard variable rate. My letter to my current lender has been ignored
Complaints against Nova Star Mortgage? In summer 2005 by the time the Nova Star agent finished refinancing my sister's home, they had caused her credit to be ruined & then put her in an ARM that increased her house payment by $500 per month. By signing time, she had no option but to sign the paperwork presented. They assigned a prepay penalty for 2 yrs. Two wks ago she finds out that it was really for 3 yrs. Nova Star has since closed the office in Phx stating that he was not really a Nova Star rep. Now in Jan my sister's house payment will jump another $500 more per month. Please do not say that she should have known better. I think it's criminal that the finance insitutions took unfair advantage of individual who were just attemping to live the American Dream & own a home. I am curious to see how many other unsuspecting home buyers were ripped. Before January there just has to be a solution other than foreclosure, bankrupcy or insanity.
Who can I contact to file complaint against a mortgage broker in the state of California? We are in the middle of a loan modification that was supposed to take 30 days to complete, it's been 6 months, now we have letters notifying us of foreclosure. The broker tells us not to worry.....(yeah right) and I can't get answers as to when the loan modification will be complete. Frank that wasn't the question!!!! but thanx anyway.
How do I file a complaint against a mortgage broker in CA? My broker took my pay stubs, bank statemetns, etc, then told me he was locking me in at a certain rate and ordering an appraisal. Then after a couple weeks, wouldn't call me back. Then by the time I go to someone else, the rates are up about .75 - is there anythin I can do or anyone I can complain to about this? Because I assumed he was doing his job, I didn't look into re-financing with anyone else, now I sort of SOL I guess.

Can I sue my bank for not lowering my mortgage repayments in line with interest rate drops? Today the Bank Of England are deciding what to do with interest rates again. From news reports I hear that it may remain unchanged. However, in the last year there have been plenty of interest rate cuts. What is the biggest scare that people have talking to Mortgage Bankers when they need help? There are so many people that have adjustable rate mortgages and when they are contacted by legitimate professionals they choose to hang up the phone or make it seem as though they have everything under control. If you feel as though there is something about the company then you can research the company and see how long they have been in business and if there are any BBB complaints out there concerning their services to clients. Everyday I talk to people who live paycheck to paycheck and have equity available in the home but choose not to use it as an asset and put themselves in a better position. I am trying to find out from people why they are so hesitant and what we can do to correct the negative stereotypes that are present.
How do we file a complaint against a bank who will not apply our mortgage correctly? We overpay our mortgage each month and have specified that it needs to go to principal. However, they periodically put it all to interest and send us letters and late fees stating we did not make a payment. We then go through weeks of trying to get it corrected. If I want to file a complaint against a mortgage broker, how do I proceed? I applied for a loan with a mortgage broker but I did not take it as I got a better rate elsewhere. I was charged $810 ($790 for processing + $20 for credit report.) for getting the loan approved (conditionally). Appraisal was not done, so I wasn't charged for that. I was forced to give a check for $810 and the check has already been cashed. It hurts to pay so much money for a loan that I did not take. How do I get my money back? Is this a RESPA violation? Who do I file a compaint with? Please advice. PS: I live in California and the loan is 80/15/5 (piggyback). They gave me a good faith estimate ($495 for 80%loan + $295 for 20% loan)
What happens if you Admit all complaints on summons but you have no money to pay ? will the enter judgment ? - this is about my 2nd mortgage lender suing for the amount I owe. I read that court will enter "default judgment"if I don't reply but If I do, the result would be the same. When I admit to complaints, will court allow a small repayment plan or settlement without entering judgment ? How can I sue my mortgage broker without going broke? I was taken for a ride by a mortgage broker. He lied to me about the terms of my loan, lied on my application about my income, and lied about numerous other things. Now I am stuck in a horrible loan where my pricipal is rising unless I make this enormous payment. I can't afford my payment and I also can't afford a ton of legal fees. My mortgage company is messing with me. I have continually asked for a loan modification? I filled out all the proper information for they required but for some reason they continually are prolonging the process. it's been over 4 months now and they have thrown every excuse possible at me. I am not sure Y. I understand that they have allot of loan modifications to do but 4 months is excessive. I would like to higher a law year but im not sure what kind. Can I get out of a 3rd party mortgage buyout? I was happy with the original loan servicer, whose company was a member of the BBB and had relatively few complaints. But they sold it to a company that has an outragious number of complaints to the BBB and is not a member. I don't feel comfortable doing business with them. Also, according to the BBB report, the new company made little effort to resolve the complaints.

Force a change of your mortgage lender? Is there a way to force my current mortgage servicing company to another one? my current servicing company, Litton Loan Servicing is horrible. They have hundreds of BBB complaints against them and I see why. Considering an FHA Loan through Chase Bank in San Diego. Any complaints about Chase? Hello, my wife and I have been in contact with Chase Bank in San Diego regarding an FHA Loan as first time home buyers. We are a little hesitant going through Chase as we don't know much about this bank. Would it be better to try and get a mortgage through a local San Diego Credit Union? I live in Florida and I need to file a formal complaint against Countrywide Mortgage.? Writing to their CEO has not helped. They adveritise "no closing costs" and when I went to refinance they tacked on 25,500.00 in closing costs!! I'm a current customer of theirs so if anything you'd think I'd get better not worse treatment than a new customer. Any information would help. I tried filing a complaint with the Better Business Bureau, but they don't handl this type of complaint.
settled on a mortgage anyone hear of this? live in tx. this has been a 6 month battle with my mortgage company, i even had to get the attorney generals office involved and they agreed with my complaint. They mortage company basicaly volunteered to refinance my 1st and 2nd loan at todays appriased value, including all closing fees ect. leaving it should to close 32k witch i was told by the company they would eat that extra. I have already closed this loan and they title company told me that they wired they diffrence to pay off those loans. Now i was talking to a friend he thinks he is a know it all, he is telling me that they will come after me and court and garnish my wages for the 32k. he works as a collector told i did a stupid thing letting them voluntering rather then me suing.

What news station in San Francisco (Bay area) deals with consumer complaints. I need professional help...? My mortgage company keeps telling me that they haven't received our payments and they're doing a research on it. I told them and have faxed them proof of official checks that I've sent and that they have been cashed. I feel that they screwed up on their end and is inconviencing and stressing us out. They are still looking for the Feb. '08 payment and I did send them proof that it has been sent. Could you please help us resolve this annoying problem?
Has anyone thought about bringing a lawsuit against Saxon Mortgage? ? What would be involved in bringing a lawsuit against a company like Saxon Mortgage? And judging by the long list of complaints that anyone can read all over the web, might a class action lawsuit be in order? I receive unwanted faxes from 1-877-301-7629. Complaints to FTCare to no avail. How do I stop them? My fax number as well as my regular numbers are registered on the do not call list. The entity faxing me the unwanted solicitations for insurance, mortgage loans, etc. does not identify itself.
who do I contact to file a complaint against a postal worker? There is no specific site for the postmaster general, just information on its beginnings etc. Postal carrier refuses to come to my door for items needing signature 4 out of 5 times. This has cost me problems with the registar of contractors, my mortgage company, etc. Made complaints in person with the El Mirage post office at least 5 times in past year with no response or change in behavior. How do you file a complaint against a mortgage company? We had a mortgage through First Horizon and it was sold to Everhome Mortgage effective 6/2/08. They don't even send STATEMENTS, but make you pay using a coupon. They didn't mail the coupons until 6/20/08 (after the June late date) and we didn't get the coupons until 6/24. We started getting collection calls on 6/26. We made the June payment on 7/1 and then on 7/10 we got yet another collection call. Who do I file a complaint with on this because this is absolutely ridiculous. We never got any collection calls from our previous mortgage companies (we have had 3 before Everhome) and have only been late once in the past by just a few days. Everhome is based out of Florida. Do I file the complaint with someone in Florida, or can I file it with someone in Maryland (where I am from)? Sadly, a supervisor is who I spoke with that was being the real jerk stating that they could start calling me on 7/2 if I hadn't paid by 7/1. My mom is a former mortgage underwriter and said technically, they can do that but most in the industry don't do it because it's not really the right thing to do. But they normally will start calling the day after the late date. I didn't have a closing - this was a mortgage that was sold to this company. They say they sent a hello letter with a temporary coupon. We did get that but not until just around the same time that the coupon books came (separately, and with no temporary coupon). My mom (who has had more time than I do) did some research on them and said this company has a history of complaints regarding people mailing payments on time and they aren't applying the payments until after the late date. They also have a bad history already with me about sending things late. In fact, we just got a notice of default yesterday (after I wrote this question) stating I owed 2 months. The thing was mailed on 7/8 yet I had made the June payment 7/1. I'm more than a little irritated with them.

A custome of mine got an insurance quote from some company online. They quoted $1400/year for a house that costs $190,000. I closed on a house 3 months ago that sold for $160,000 and their insurance was $3300/year. Something doesn't sound right, especially since we are in a hurricane affected area. Soemone please help!!!
Northern Rock - New mortgage and already probs. Where do I stand? I am currently going through a mortgage application with Northern Rock, as a first time buyer. 3 wks ago a query was raised and resolved about the property address (Land Registry held it differently from all other paperwork etc.) NR wanted to make sure they had valued thecorrect property. I was to exchange contracts 20th June and complete 29th but NR raised this issue again, with no record of it being discussed before. 2 weeks later I've still not exchanged, the valuer was contacted 1 week ago to confirm the correct property was valued yet no response. I paid 475GBP for the valuation yet he is very slack now! NR don't seem to have any urgency! My buyer is questioning my commitment to the purchase but I really want the house! My arrangement fee is huge and what for?? NR asked today when I wanted to exchange and complete.....as mentioned - they know I wanted to exchange 2WEEKS ago!!! Where do I stand in terms of making a complaint once my mortgage is finally drawndown? Thanks in advance.
I paid a company(attorney's) to help me get my mortgage modified. They did not do that.? Who do I go to help me get a refund? They had my file for more than 7 months and did nothing. I want to report the company for their practices. I filed a complaint with the BBB who else can I go to. Mortgage Foreclosure? I am renting a property,,,and when I came home the other day a notice was on my door it says....NOTICE OF RESIDENTIAL FORECLOSURE DIVERSION PROGRAM.....IT ALSO SAYS...A JUDGEMENT HAS BEEN ENTERED AGAINST YIU AND PROPERTY IS ABOUT TO BE LISTED FOR SHERIFF'S SALE....but then there is another paper that came with it that has an ORDER FROM 2008 in FEB that says...upon consideration of plaintiff ( mortgage company) and the affidavit of good faith investigation attached hereto it is hereby ORDERED that service of complaint in Mortgage Foreclosure and all subsequent pleadings on (defendants) shall be complete when plaintiff or its counsel has mailed true and correct copies of the complaint to the last known address of defendants....well i came home yesterday and this notice was on door....so can someone please explain this to me and has this house been under foreclosure since last year? like have i been paying rent and my landlord knew it was undergoing foreclosure? and if so isn't that against law? guess i can't get that much help on this question even with all the details...oh well thanks anyway...and that websitehttp://www.ebiznus.com/real.html....sucks it has nothing to do with my question
Who or where can I file a complaint against my mortgage company? They have jacked my rate astronimcally!? Rates are dropping, and even though I have a great LTV and payment history my adj. rate mortgage just jumped to 10.11%. I know what I signed and realize they can, but why jack it so high they force me into foreclosure? Then they cry that they need bailing out? I don't think so - I think mortgagees need bailing out from unscrupulous lenders. Is the Community Reinvestment Act responsible for the govt bail out of the mortgage industry? ? The Clinton administration has turned the Community Reinvestment Act, a once-obscure and lightly enforced banking regulation law, into one of the most powerful mandates shaping American cities—and, as Senate Banking Committee chairman Phil Gramm memorably put it, a vast extortion scheme against the nation's banks. Under its provisions, U.S. banks have committed nearly $1 trillion for inner-city and low-income mortgages and real estate development projects, most of it funneled through a nationwide network of left-wing community groups, intent, in some cases, on teaching their low-income clients that the financial system is their enemy and, implicitly, that government, rather than their own striving, is the key to their well-being. The CRA's premise sounds unassailable: helping the poor buy and keep homes will stabilize and rebuild city neighborhoods. As enforced today, though, the law portends just the opposite, threatening to undermine the efforts of the upwardly mobile poor by saddling them with neighbors more than usually likely to depress property values by not maintaining their homes adequately or by losing them to foreclosure. The CRA's logic also helps to ensure that inner-city neighborhoods stay poor by discouraging the kinds of investment that might make them better off. The Act, which Jimmy Carter signed in 1977, grew out of the complaint that urban banks were "redlining" inner-city neighborhoods, refusing to lend to their residents while using their deposits to finance suburban expansion. CRA decreed that banks have "an affirmative obligation" to meet the credit needs of the communities in which they are chartered, and that federal banking regulators should assess how well they do that when considering their requests to merge or to open branches. Bait & Switch by a mortgage broker? I got a GFE from a mortgage broker, he had run my credit and said I can get this loan he illustrated in the GFE. Now after I have paid for an appraisal he is telling me that the lender ran my credit and my score has gone down. I subsribe to my fico and per my fico there is not another inquiry besides the one he ran. He now wants to give me a way higher interest rate, I told him I want proof that the other lender rejected me and he says he can't provide such, and i want a copy of my credit report showing that my score had gone down. They do not want to provide me this info. either. I feel that I have a right to this information. I have now filed a complaint with the BBB and am planning on contacting the DRE. How to file a complaint against a mortgage broker in NY? I was cheated by my Loan Officer who promised me 6.25% interest and $1500.00 refund from my Loan amount due to my not paying the points and not charging Survery and Termite Inspection. When the closing papers came, I was shocked to see that I was given 6.50% interest rate and the amount that was to be refunded was named as Fee which HAD to pay. On calling him, he told me to go ahead and sign the papers and he will definitely get back what I was promised. The 3 day loan period went back very fast by his false promises and then after that, he stopped taking my calls. Now everybody says that since I signed the papers, nothing can be done. I feel cheated. Is there anything I can do about it??
Can the mortgage company come after me after my co-owner files for bankruptcy on the home? I own a home with another person. They moved out. The home is about to be foreclosed. She wants to file for bankruptcy to stop the foreclosure. Can the mortgage companies then come after me alone for the mortgage payments and foreclose on me if she is protected by bankruptcy? We are both on the deed to the house and letters come to both of our names from the mortgage company. The legal complaint says john doe et al so I am the et al. I was thinking about selling my half of the home to her before she files for bankruptcy so that I have no more claim to the home. Is this possible? We live in New Jersey. I am not interested in working out a deal with the mortgage company to continue payments and stay in the house. She did abandon the house but is not in a rush to sell the house. A short sale in this market is unlikely. She is planning on filing chapter 13 to save the house from going into foreclosure, so I need to know if after she files chapter 13 will the mortgage company be able to come after me.
House Damage, Insurance Check & Mortgage Company Rules? Some stuff not included under mortgage.? Survived Hurricane Ike with a lot of damage. Nearly 20K. Because of the amount is over 20K the mortgage company tacks on a LOT of rules - one is Licensed Contractor, the county I live in doesn't require that. You aren't allowed to DIY. Also they will only give out 1/2 and then you have to wait for their inspector to come out once EVERYTHING is done. Two items put my insurance claim over the DIY limit - a Shed & a building we were in the process of building & wasn't part of the original mortgage. With all the mortgage companies going down, my thoughts is bucking this & at worst find an escrow company. My mortgage company is Saxon & doing some research, seems they have many complaints regarding releasing insurance funds AND paying out escrow (taxes & insurance). They weren't my original mortgage company, but mine was sold 3? times.... I just want my money to fix my property - some things like PAINTING I can do myself, jez.... Thoughts? Is this LEGAL (requiring a contractor for everything)? Anyone? I'm in Texas
Mortgage Needed, Please Read Specifics? We are in need of a mortgage for the amount of $92,500.00. We have no money to put down so this would need to be a 100% financing, I have poor credit from a past divorce which I am still paying for many, many years later but have been for the past 4 years slowly eliminating some of the debt and the negative reports which should not be there and even some that are not mine. My present Wife is permanently disabled and receives SSI. I have a 10 month seasonal job making $11.00 an Hr. We currently pay $670 for rent, plus utilities and I have researched what this mortgage payment would be with "no money down" and the taxes and insurance and it is cheaper than what we already spend monthly where we are at. We presently rent a 2 bdrm that has mold growing on the walls and you can't drink the well water, it is contaminated with "acid, iron, and bacteria" and the landlord does nothing about the complaints from us or other tenants except to temporarily fix the problem instead of fixing it right. I do not want a response from some joker who says, "I can help" and then does not give me any thing else to work with, (ie) phone number or company name, nor do I want any scams, I will take legal action against any scammer. We will be looking at another home today, but I need some answers soon. Thanks to anyone who will assist us in getting our new home.
Can i sue my mortgage company? I applied for a mortgage about 6 months ago and got approved under certain stipulations. The mortgage company forced me to take out extra money to pay for a "warranty" on all my home appliances. My water heater started leaking last night and i called them ,they told me to call the warranty company and now the warranty company says they will not cover it. The funny thing is, the woman i talked to at the mortgage company talks too much and informed me that she was not using this warranty company anymore because they had way too many complaints on them. Also i was forced to pay for 4000 dollars worth of "repairs" to my home when the loan was taken out (added to the original loan amount also). I have worked many years in construction,my father has ran his own construction business for 25 years so i know about how much money is involved with what the company hired by my mortgage company did would cost and it doesnt even come close. Maybe 250 dollars worth of work. Legal recourse? some things i didnt have room to post! The woman i talked to at the finance company told me i could get my money back that i paid the "warranty" company, of course from the "warranty" company not the mortgage company. But shouldnt i ask for it back from the mortgage company and all of the interest or fees i will be charged for that amount also? Seems like a breach of contract or something, to me, so do the "repairs" i am paying monthly on with interest! The repairs were supposed to be new attic door,new steps, new crawlspace door,silicone around the roof screws (metal roof) , paint all the trim and new trim in some spots. I paid 3925.00 for this.Here is what i got- new attic door! four six foot pine boards nailed down on top of the old steps that were there already, handmade crawlspace door from presswood, nobody ever got up on my roof i know because i work from home.One 2 foot length of trim, trim spray painted without being sanded or stripped, paint is already peeling.250 maybe!
After the elimination of taxes, mortgage payments next? I hear the words, “I want the government out of my life.” and I hear ‘interference’ and ‘coercion’ as the apparent major complaints. However, if you feel this way about the government and the burden of taxation, do you also feel this way about banks and mortgage companies that pry into every intimate detail of your privacy, attach themselves to your hip for life and hold you under a lifetime perpetual threat of dispossession and expulsion to the outdoors? Do you also resent that interference, that coercion and the burden of that payment? Do you also want them ‘out of your life’? If you hate the government, shouldn’t you hate your mortgage company more? If you hate taxation, shouldn’t you hate mortgage payments more? If you are ready for action against taxation, does that mean you are also ready for action against mortgages? How do you protest only one of these two? OH BOY! I knew it was coming, I even wrote an expectant admoshment in advance but then told myself, let the people answer the question without issuing instructions, but lo and behold, there it is... the CONSENSUALLY MUTUAL RELATIONSHIP! YES! That's the big difference, isn't it? Yeah, government is coercive, you don't vote, you don't have representation, you're not involved in the process but mortgages? Oh, yeah, you totally vote for everyone involved and they are all about your interests and representing you. Your need to borrow money and purchase your life on the planet is NOT 'consensual'. Those conditions are imposed on you before your birth. You WILL pay for your life here and you will 'choose' your mortgage the way your choose your government representative. You make superficial 'choices' in an imposed system you never chose. They are the same, not different. The lies your are telling yourself are more repulsive than the lie you are trying to tell me.
Mortgage bailout help? I am with City Mortgage my original lender on my home, I applied for a bailout but they keep asking for more paperwork some of it is paperwork I have already submitted, It has been almost a year and it is ruining my credit, which they claim when this goes through will be fine. I am making the payments on time as they already have that set up they just wont finish it to clear up my credit!! I also saw on complaints board that I am not the only one with this problem. the new payment plan is being met not the old one and since it has not been what they call modified the old loan is showing as delinquent.

By Jennifer Delson and and Christopher Goffard, Los Angeles Times Staff Writers October 8, 2007 Soledad Aviles dreamed for years of owning a home, with a plot of land where he could grow corn and chiles as he did in his native Mexico. So he felt blessed last year when he learned he could buy a three-bedroom, single-story stucco house on West La Verne Avenue in Santa Ana. Referred to a local loan broker by a trusted friend, he borrowed the entire purchase price of $615,000 from Washington Mutual at a high interest rate typical of sub-prime loans. The monthly payment, as he says he understood it, would be $3,600 -- steep for a glass cutter who made $9 an hour -- but Aviles counted on his wife and three of his six daughters, who also worked low-paying jobs, to contribute. "We took out our pencils, figured out our take-home pay and figured out that if we all pitched in, it would work," said Aviles, 54, a stoop-shouldered, soft-spoken man with a sixth-grade education from Mexico. Relying on the broker's word, he signed loan documents written in English, a language he neither speaks nor reads, Aviles said. He was shocked to learn afterward that the monthly payment would not be $3,600, but $4,800 -- a price that forced him to rent out bedrooms, the garage and an enclosed porch while he and his wife slept on the couch. He fed his family with food from friends and corn he grew. Aviles says he was not aware that the February 2006 loan application he signed dramatically exaggerated his family's income. The application lists him as the owner of a landscaping business with a $7,400 monthly income. His 27-year-old daughter Marlene, who earns $9 an hour in a noodle factory, appears as the owner of a housecleaning company who makes $5,700 a month. The application lists their yearly income as $157,000, when, according to Aviles, it was really closer to $60,000. Now, five months behind on his payments, Aviles is scrambling to sell the house before the bank forecloses. Desperately ill from kidney disease and unable to work for the last year, he sits dejectedly at the dining room table, wondering when the bank will kick him out. Aviles' situation is hardly unique. Add his name to the ever-expanding list of casualties in the nationwide sub-prime mortgage debacle, his experience echoing that of thousands who bought homes in recent years only to find themselves in a sagging market saddled with payments they cannot make. But amid the storm of foreclosures, his story illustrates the special vulnerabilities of first-generation immigrants in places like predominantly Latino Santa Ana, where city leaders have identified about 800 sub-prime borrowers facing the potential loss of their homes. "We think this is just the tip of the iceberg, in terms of the breadth and depth," said Steve Harding, Santa Ana's deputy city manager. Apart from the language barrier, he said, many first-generation immigrants might have been especially vulnerable to sub-prime lending because they avoided checking accounts and credit cards, which prevented them from qualifying for regular loans. The city has teamed with the Fair Housing Council of Orange County to offer free foreclosure prevention workshops, hoping to teach people to avoid predatory lenders and find help as they face the loss of their homes. The Fair Housing Council said the number of people seeking help over mortgage woes, many of them Latinos living in Anaheim and Santa Ana, has soared. The group typically receives 15 to 20 complaints annually, but in September of this year the group received more than 20. The state Department of Real Estate, nonprofits and the Mexican consulate also have reported a rise in mortgage complaints, many of them from homeowners saying they signed documents they didn't understand. Across the state, many cases are landing in court. Kerstin Arusha, a directing attorney at the nonprofit Law Foundation of Silicon Valley, said that Spanish speakers, along with the elderly, "seem to be hardest hit by both sub-prime lending and predatory lending. There are many borrowers out there that were misled about the terms of the loan." The Law Foundation is suing a broker, real estate agent and lender in federal court on behalf of nine Santa Clara County families, many of whom speak only Spanish, contending they were lured into mortgages they didn't understand. The lawsuit alleges that the broker inflated incomes on loan applications, misrepresented the terms of the loans and stuck clients with higher payments than they had been promised. The victims "thought they saw the promise of the American Dream, and instead they ended up with a nightmare," Arusha said. "I think they were seen as easy targets for predatory lenders who could sell them a bill of goods without giving them disclosures in a language they understand." The Law Foundation is handling 10 other cases involving predatory lending, half of them for Latino clients, Arusha said. But in Orange County, the district attorney's office has not reported an increase in prosecutions for fraudulent lending. Elizabeth Henderson, a prosecutor in the county's fraud unit, said many such crimes go unreported in immigrant communities because of a distrust of law enforcement and confusion over what had occurred. "They're not really sure what they were promised, so they don't know if they were cheated," she said. Sitting in his Santa Ana home, waiting for the bank to kick him out or for his kidney to kill him, Aviles did not hesitate to characterize what had happened to him: "They used me, nothing more." He was led astray, he said, by a man he had considered a dear friend, Carlos Lares. They used to work in a factory together. He said Lares showed him about a dozen homes, including the one he bought, and offered to arrange a mortgage. State records show Lares lacks the real estate license required to show homes. In an interview with The Times, Lares denied showing homes and said he merely took Aviles to the office where he works, Century 21 South Coast. He declined to comment further. His business card lists him as a "team service associate." Part of me does feel bad for him, but he was stupid to think he could even make payments o $3600 a month, when he and his wife only make $9.00 an hour. My parents got their home through a VERY CORRUPT mortgage company that is trying to steal their money AND get them evicted. They always say they havent received payments when we have all the receipts, they are now trying to have my parents evicted, we just got a NEW letter stating they havent received ANY payments since August 2008 which is a complete and utter lie; we have the receipts. Well, my parents will be letting the house go, they can't handle all this harassment anymore plus the company wants THEM to take the time to trace ALL the money order payments that they've sent over they years. I just went on-line and have seen THOUSANDS of complaints against this company and i want to know who and how can we get these son's of bitches out of business and why they are being allowed to ruin all the hard working people's lives. Any help will be GREATLY appreciated. My parents had a lawyer and went to court but he didnt do anything to help either, think he was in kahoots with the company2
how do i serve a writ against my mortgage lender for mis-information? 1. Basically refused top loan only ask for £15,000, NO explanation 2. They then paid off £70,000 in mistake on the mortgage , reduced monthly payment, when I enquired refused to acknowledge or reply.It took 3 months AFTER I chased the issue for the correct figures being re-instated. 3. By this time it was too late , as I was applying for additional funding loans, re-mortgage got an offer from the Abbey, but had to decline as they had conducted reaches on the WRONG figures being supplied by the Halifax. This escalated by total refusuals from any potential lender . Thanks to he Halifax Iwas made to look fraderlant and dis-honest. 4. They have ruin my credit rating which may never be restored to it's xorrect level. 5. Have left me in financial ruin, with no one to turn to. 6. Caused no end of family stress and grief. 7. The Halifax have NEVER apolgise or reply to numerous numbers of complaints , I even pleaded with them to write to the Abbey, and ALLthe other company to explain THEIRmistake or just a coverinfg letter to explain what had happened but again NO reply ever. 8. How to Survive this Black Hole of Divorce, Mortgage, Debt? Sorry so long. At this point, I will listen to anyone. Brief Outline: 1) Divorced - ex refinances house adding almost $90K, legal battle of how and why this could happen, but nothing can be done to change current mortgage or his paying debt 2) have house I'm living in inspected' $75K structural flaws discovered, structural engineer confirmed, tried to sue builder but not in business, got appraisals, talked to real estatee agents, wrote & talked to politicians and charities but no help available.No expected proceeds from sale, 3) ex did not pay spousal and child support for 3 1/2 years . which will not be paid back to me. 4) In collections for $30K Credit Card debt of living expences during proceedings. Which lawyer said would be paid back to me by ex But It Will Not. Filed complaints about my lawyers but being a stupid lawyer is not malpractice 5) Divorce is final, Everything possible has been done to examine and challenge the above rulings. 6) Decreased all expences:. am trying to save for car, mortgage modification Denied. 7) Increaed Income: All jewelry sold, household items and clothes sold on ebay, took part-time low paying job, Due to health Problems can not work any more hours 8) Going Bankrupt: papers being filed right now Does anyone see a way to survive this? Receiving personal check for loan commission? Can I, as a loan officer with the same mortgage broker, file a complaint about a loan officer who issued her personal check as my commission? I cashed the check, but, I am not aware that this is a violation under RESPA?
Should I report my mortgage broker to better business bureau? I dont understand why my broker didnt lock my rate when I recieve the contract my rate was 9.87 I told him I agree, and lock it. He didnt want to at the time because he said he was still shopping for a better rate. A month went by and the rate went up a little so i ask him to lock so it wont go up again he never did it. now just a few days away from closing he called me, and said that I need to come up with $ 4500 to bring down my interest rate or I wont be qualified for the loan because the rates went really high, and also if my credit score goes one point down I wont be qualified, the only reason my credit went down from the time he check it because he had submitted my info to more then one bank. Right know I feel that my back is against the wall, I have no choice but to come up with the money, I believe he scam me, he knew exactly what he was doing. Will my complaint to BBB will help me get this guy out of business
